Terms of Use

You must use Factogo in a truthful, lawful manner that does not infringe the rights of others. You are responsible for the content you submit and warrant that you have the right to post that content, and that the content is not unlawful and does not infringe privacy, copyright, trademark, reputation, or any other third-party rights.

You retain your rights in your own content. However, for the purposes of operating, maintaining, improving, protecting, and promoting the platform, you grant Factogo a non-exclusive, worldwide, royalty-free, sublicensable, and transferable licence to store, back up, copy, format, display, publicly transmit, translate, excerpt, create thumbnails from, rank, review, edit into a non-identifiable format, restrict the visibility of, and remove your content during the service period and for a reasonably necessary period thereafter. Factogo may also reasonably use your content on its own channels to introduce or promote the service.

Factogo may, at its discretion and based on these Terms, platform policies, applicable law, the public interest, user safety, platform integrity, or operational needs, decide whether to display, hide, downrank, label, restrict the visibility of, remove, or reject any content. Factogo may also restrict, suspend, or terminate any account or account function.

Except as otherwise required by applicable law, the services and content provided by Factogo are provided on an “as is” and “as available” basis. Factogo does not guarantee that any review, rating, photo, response, or building information is absolutely accurate, complete, up to date, reliable, or suitable for any particular purpose, and Factogo does not endorse user content.

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Factogo and its affiliates, directors, employees, contractors, and agents from and against any third-party claims, liabilities, losses, costs, or expenses arising from your breach of these Terms, infringement of third-party rights, unlawful use of the platform, or content submitted by you.

Any dispute relating to use of the platform will be handled in accordance with applicable law, these Terms, and any regional terms or supplemental terms that Factogo may provide from time to time. Where mandatory consumer protection laws in certain regions grant users specific rights, those rights will not be excluded or limited by these Terms.

Factogo will retain data only for as long as necessary to achieve the purposes of operation, compliance, safety, risk management, dispute handling, platform protection, and legally required retention. Where there is an ongoing dispute, legal hold, request from law enforcement or a competent authority, or where applicable law otherwise requires, Factogo may extend the retention period.
